1. These terms
     
    • What these terms cover. These are the terms and conditions on which we supply our Service.
    • What is our “Service”. Our Service is to place your takeaway food order (“Order”) with our partner restaurants.
    • Why you should read them. Please read these terms carefully before you submit your Order from our partner restaurants’ site through our ordering system. By accessing their site and placing any Orders, you agree to be bound by these terms and conditions and their website terms of use policy. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

  2. Information about us and how to contact us

    • Who we are. Orin is an ordering system operated by Sonat Digital Marketing Ltd (“we” or “us” or “Sonat Co”) a company registered in England and Wales. Our company registration number is 11647034 and our registered office is at 7 Bell Yard, London, WC2A 2JR .
    • How to contact us. You can contact us by telephoning our customer service team at +44 7493548971 or by writing to us at hello@sonat.co .
    • How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your Order.
    • “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
  3. The contract with you

    • How our Service works. We work with our partner restaurants (the “Restaurants”) to display their food options available for takeaway and allow you to place an Order from their website through our integrated ordering system (“Orin”). We act as an agent on behalf of the Restaurants strictly in relation to an Order for the exclusive purpose of concluding a contract based on an Order made. All deliveries will be made by the Restaurants directly.
    • How your Order will be accepted. The acceptance of your Order will take place when we have submitted your Order to the Restaurant and the Restaurant has accepted the Order. An email will then be sent to you confirming your Order details. The contract for the supply of any Order you make through us will be between you and the Restaurant and will only be formed when you have been sent the acceptance email by us.
    • Acting on your own behalf. Any Order made shall be on your own behalf and not for any other person.
    • Incorrect details. It is your responsibility to check all email addresses, delivery addresses and telephone numbers before submitting an Order.
  4. Payment

    • Prices. Prices are listed on the Restaurants’ websites within the Orin platform and will vary between Restaurants and their menus. We are not responsible for any change in the prices. In case of obvious pricing errors, please contact directly the Restaurant.
    • How to Pay. Payment is taken by credit or debit card when placing an Order through us. Once your Order has been confirmed, your payment will be authorised and marked for payment. Payment is made directly to the Restaurant’s payments account. You can also make your payment in cash directly to the Restaurant by paying their delivery driver at the time of delivery. Options for cash payment where possible, will be made clear before you place your order.
  5. Your rights to make changes and cancellation

    • Making changes to an Order. If you wish to make a change to the Order please contact the Restaurant as soon as possible. They will let you know if the change is possible. If it is possible they will let you know about any changes to the price to the Order, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
    • Cancelling an Order before preparation. You have the right to cancel an order within a reasonable time and before the Restaurant has started the preparation of the food listed in your Order. Where you have cancelled in accordance with this clause, you will not be charged for those items which the Restaurants has accepted the cancellation from your Order.
    • Cancelling an Order after preparation. Where you wish to cancel an Order after food has been used to start preparing your Order, you will be charged for the full Order.

  6. Liability

    • Ingredients and Allergies. All meals in any Order are made by the Restaurants and we do not hold any liability in respect of the meals. The Restaurants may use nuts in the preparation of certain meals and we cannot guarantee meals are free of any allergens. IT IS YOUR RESPONSABILITY TO CONTACT THE RESTAURANT IF YOU HAVE ANY ALLERGIES AND TO INFORM THE RESTAURANT OF SUCH ALLERGIES BEFORE PLACING AN ORDER.
    • Damages: To the extent permitted by law, Orin provides the Service and content on an “as-is” and “as available” basis and we make no representation, warranties or guarantees of any kind, express or implied, regarding the content or availability of our Service, or that it will be timely or without error or that defects will be corrected. Except as set out below, neither Orin nor any Restaurant shall be liable to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of, or your inability to use, our Service or use of or reliance on any content displayed on our site. This does not exclude or limit in any way Orin’s or any Restaurant’s liability for any matter for which it would be unlawful to do so including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation. In the event that Orin or the Restaurant is found to be liable to you our total aggregate liability is limited to the purchase price of the Order.
    • Information on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.
    • We are not responsible for websites we link to. Where our site contains links to other sites and resources provided by the Restaurants and other third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. Please note that we have no control over the contents of those sites or resources.
    • Events outside our control: No party shall be liable to the other for any delay or non-performance of its obligations under these terms arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, flood, collapse of buildings, fire, explosion, accident, interruption or failure of utility service and civil commotion. For the avoidance of doubt, nothing in this clause shall excuse the customer from any payment obligations under these terms.
  7. How we may use your personal information

  8. Other important terms

    • No Agency: Nothing in these terms is intended to constitute Orin as your agent or authorise Orin to enter into any commitments for or on your behalf.
    • If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    • Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
